Kinder Surprise Eggs Are Banned In The USA, here's why

Surprise, surprise.

For a colourful children’s egg, Kinder Surprise comes with a very serious warning. Printed on the back of the packaging it says, “Not suitable for children under three years” and “adult supervision recommended”.

That is because there have been cases around the world that involving children accidentally eating the plastic toys, which poses a choking risk.

As it turns out, in the Wild West (and East, and North and South) of the US of A, inserting plastics into food can create an “adulterated” product, which, according to 21 U.S. Code § 342, is illegal to sell.

To get around the law, the US have their own version of the Kinder Surprise called the Kinder Joy, where the toy is kept in a plastic capsule inside the egg so you don’t accidentally eat it.

The Kinder Joy was originally developed to sell the chocolate treats in warm-weather markets (such as India, China and Korea) where the traditional exposed chocolate egg melted.

Tourists who unknowingly bring a Kinder Surprise into the US – or engage in nefarious underground confectionary rings – can face major fines up to $2,500. Talk about a bad surprise.

So... they copy the European version then. The plastic container is as well known as the toys inside them. Literally, what am I missing here?

I refuse to believe they're not going alter their product to access the US market. So what's it really about?

Yes. They did alter the product, and they do sell it in the US.

OK, I went and checked it out. The article's pretty misleading because it literally just describes the EU egg.

Bob AmbassadorOP 1w

Yes, and I took it that the EU egg, is what they market in the US as the Kinder Joy. Could be wrong...maybe someone in the USA will check it out for us :)

Ohhh I’ve heard about this 7 or 8 years ago but I still saw them in stores, the localized version makes sense lol.

... I never knew a kinder surprise that don't have the toy inside a big plastic capsule. It was already like this 30 years ago in Europe... So it's probably propaganda to make their own American version.

Apparently it had to do with climate.

$2500 for unknowingly bringing?? Thats outrageous! This makes me think about speeding completely differently. I got pulled over doing 140 mph and the fine was less.

Well Kinder egg capsules do have a long history with the drug smuggling trade. Maybe they're trying to send a loud message to not bother lol.

It sounds like they can still do it, just inside a plastic container in the egg. The banned version is just chocolate and the toy.
